“Compensation Plans: Identifying Potential Liability for Maryland Employers,” 2007 Maryland SHRM State Conference

RDB partner Stephen Stern presented “Compensation Plans: Identifying Potential Liability for Maryland Employers” at the Maryland State SHRM Conference on December 4, 2007, in Adelphi, Maryland. Class action lawsuits under the FLSA remain in the headlines. While most employers are familiar with the FLSA’s general framework, many employers run afoul of its requirements. However, there is more to the legal landscape than the FLSA when it comes to formulating compensation plans. For example, employers need to be familiar with the Maryland Wage Payment and Collection Act, and develop compliant bonus and commission plans (among other forms of compensation). Many employers also are sued for various reasons in connection with their ERISA plans. The presentation identified certain areas of potential exposure under these statutes to help Maryland employers reduce the risk of liability when developing compensation plans.
