Professional Liability Update 2007: A Year In Review

2007 was an active year for courts facing issues that impact professional liability insurance. Courts found many occasions to consider the effect of an insured’s failure to provide timely notice of a claim or potential claim, for instance. Similarly, courts handed down several cases interpreting what “services” were “professional,” with interesting and somewhat inconsistent results. The RDB Professional Liability Insurance practice group has released a survey that identifies some of the noteworthy professional liability insurance decisions over the course of 2007 to provide an overview of the varied decisions of significance to professional liability insurers.
