RDB has represented a number of clients involved in Nuclear Regulatory Commission (“NRC”) matters, and one of our partners, Bill Briggs, is the former Solicitor of the NRC. As Solicitor, Mr. Briggs personally handled or directly supervised all litigation involving the NRC, including enforcement actions, licensing decisions, and rulemaking activities, while also defending the agency in lawsuits involving tort claims, employment matters, the Freedom of Information Act, and the Sunshine Act.
Invariably, these matters involve complex factual allegations, intricate procedural issues, and novel legal questions -- all requiring extensive familiarity with the NRC. RDB’s current clients often include company directors and employees who are under investigation for allegedly violating NRC rules and regulations. Our experience and expertise in these matters includes the following:
- We represent clients facing investigation into allegations of violation of NRC rules and license conditions.
- We defend clients in NRC pre-enforcement actions, including possible NRC sanctions related to alleged discrimination against whistleblowers or making alleged false statements to the NRC.
- We have represented clients in dozens of NRC investigations and pre-enforcement proceedings. The NRC has never taken formal enforcement actions against any of our clients.
- Mr. Briggs made a presentation to an NRC Special Task Force reviewing issues related to enforcement actions against non-licensed individuals.
- Mr. Briggs has also been part of a team of attorneys representing the state of Nevada in connection with the federal government’s highly-publicized attempt to develop a nuclear waste repository in Yucca Mountain, Nevada.
- We have conducted investigations for various nuclear utilities into allegations of wrongdoing at nuclear power plants and we have prepared reports based upon these investigations that have been relied upon by utilities and the NRC.
