“The FTC v. Cephalon case: What does it mean for future brand-generic patent settlements?” ABA Section of Antitrust Law

RDB partner Merril Hirsh will participate on a panel of antitrust experts in a brown bag session hosted by the Health Care and Pharmaceuticals Committee of the ABA’s Section of Antitrust Law. The panel will closely examine the Federal Trade Commission’s case challenging Cephalon’s patent settlements regarding Provigil. The panel will provide insights into how the Commission’s factual allegations, approach under Section 2 monopolization principles, and filing in federal district court differ from prior patent settlement cases and how lawyers can effectively counsel clients in this area. Michael Kades, Attorney-Advisor at the FTC, will moderate the panel.
