On April 24, 2008, Merril Hirsh presented “Should We Allow Brand Companies to Pay Generics to End Patent Challenges: James J. Kirkpatrick Meet Shana Alexander” at Law Seminars International’s Pharmaceutical Antitrust conference. This intensive two-day conference addressed the antitrust issues that can come into play at every stage of a pharmaceutical product’s life cycle. Drawing upon his experience testifying before the Senate Judiciary Committee in 2007, Mr. Hirsh discussed the bright line rule preventing reverse payment settlements, as well as the Hatch-Waxman Act.
