Antitrust

RDB maintains a dynamic antitrust practice, representing clients in a wide variety of industries, in both individual and class action cases. Our practice is unusual in that we represent parties on both the plaintiff and defense side, and recognize that clients can be accused of antitrust violations in one market, while being the victim of price fixing in another.

For example, in a recent individual antitrust action, RDB obtained a multi-million dollar settlement in excess of single damages on behalf of its plaintiff client.  In addition, we currently serve in senior litigation positions on behalf of consumer classes consisting of commercial as well as individual clients. A large number of these cases involve allegations of price-fixing among manufacturers in large product markets such as polyester staple, foundry resins, publication paper, plastic and rubber chemicals, and sulfuric acid. Characteristics of our practice include the following:

  • We have represented one of the larger purchasers of carbon fiber and its principals in high-profile antitrust and False Claims Act litigation against nine of the nation’s largest law firms.
  • Some of our most high profile work involves representing the interests of corporate, union, government, and consumer drug buyers in litigation against pharmaceutical companies that have allegedly conspired to keep generic drugs off the market. These cases have included the makers of Relafen, Neurontin, Ciprofloxacin, and others.
  • We have developed a strong reputation in the field and our antitrust team of over 20 lawyers has been chosen to publish in high profile antitrust publications. For example, we drafted the Section 2 chapter of the ABA’s Comprehensive Antitrust and Telecommunication Practice Guide, released in Spring 2005, a chapter of the ABA’s monograph on Illinois Brick, and an article in the ABA’s Antitrust magazine on pharmaceutical antitrust cases.

In addition, the antitrust team regularly publishes online Antitrust Alerts that report on and analyze the significance of current developments in Section 1 and 2 litigation. Our subscribers include hundreds of individuals, each of whom signed up to receive our alert. Our antitrust lawyers also frequently instruct at continuing legal education seminars and speak at industry functions on antitrust and class action matters.
